Terms of Service
Welcome to Stixrs (located at stixrs.com). These Terms of Service ("Terms") govern your access to and use of our website, software, and services (collectively, the "Services"), operated by Soliroush LLC ("we," "our," or "us"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.
1. Acceptance of Terms
By creating an account or using Stixrs, you confirm that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy. These Terms apply to all visitors, registered users, and anyone else who accesses the Services.
If you are using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use our Services. By using the Services, you represent and warrant that you meet this requirement. We reserve the right to suspend or terminate accounts found to be operated by individuals who do not meet these requirements.
3. User Accounts and Security
To access certain features, you must create an account. You agree to:
- Provide accurate, complete, and current registration information
- Maintain the confidentiality of your password and account credentials
- Notify us immediately at Contact Form of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
Soliroush LLC will not be liable for any loss or damage arising from your failure to comply with these requirements.
4. User Responsibility and Sole Liability
You acknowledge and agree that you are solely and entirely responsible for all your actions, content, and the data you process, submit, or transmit through Stixrs.
- We act strictly as a neutral technology platform. We do not endorse, validate, or guarantee the accuracy of any user-generated content or actions.
- You assume all risks associated with your use of the Services, including any reliance on their accuracy, completeness, or fitness for a particular purpose.
- You are solely responsible for ensuring your use of the Services complies with all laws and regulations applicable to you and your end users.
5. Strictly Prohibited Conduct
You agree not to use the Services for any unlawful, harmful, or malicious purpose. Specifically, you agree not to:
- Violate any applicable local, state, national, or international law or regulation
- Transmit material that is abusive, harassing, defamatory, obscene, fraudulent, or otherwise objectionable
- Distribute malware, viruses, ransomware, or any other harmful code
- Attempt to gain unauthorized access to our systems, servers, networks, or user accounts
- Reverse-engineer, decompile, or disassemble any part of the Services
- Scrape, crawl, or harvest data from the Services without our prior written consent
- Use the Services to send unsolicited commercial communications (spam)
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Infringe the intellectual property, privacy, or other legal rights of any third party
Violation of this section will result in immediate termination of your account without notice and may subject you to civil and/or criminal liability.
5. No Emergency Services (911 / 112 Disclaimer)
STIXRS ESIMS ARE MOBILE DATA SERVICES AND DO NOT SUPPORT EMERGENCY VOICE CALLS OR EMERGENCY TEXTING (SUCH AS 911, 112, OR 999).
You acknowledge and agree that Stixrs is not a substitute for traditional cellular voice services. In the event of an emergency while traveling, you must use a local cellular voice line, local SIM card, or fixed landline to contact emergency services. Soliroush LLC shall have no liability whatsoever for any failure to access emergency services via our data eSIMs.
6. Pricing, Payments, and Refund Policy
Stixrs provides prepaid international data eSIM packages. Pricing and package details are presented on our website prior to purchase.
- Prepaid Purchases: Charges for eSIM data plans are processed immediately upon order confirmation using your selected payment method.
- 14-Day Refund for Unused Plans: If you change your mind or your travel plans change, you may request a refund within 14 days of purchase, provided the eSIM profile has not been downloaded, installed, or activated on any device. Refund requests for unused plans will equal the original purchase price minus non-refundable payment gateway processing fees incurred during checkout.
- Defective or Non-Working eSIMs (100% Full Refund): If an eSIM profile is defective, fails to connect due to a verified technical failure, or cannot be provisioned due to an error on our end, you are eligible for a 100% full refund with zero processing fees deducted.
- Installed & Downloaded Working Profiles: Once an eSIM profile is downloaded or installed on a device, it is permanently provisioned by our partner network carriers. Once downloaded, working profiles cannot be deleted, recycled, or returned, and orders become non-refundable unless caused by a verified technical failure on our end.
- Fair Usage Policy (FUP) & Unlimited Plans: Unlimited data plans are subject to local roaming partner Fair Usage Policies (FUP). To maintain network quality for all subscribers, high-volume data usage may result in temporary speed reductions (throttling) by local network operators. Speeds reset daily at midnight local time.
- Local Carrier Performance: Network coverage, signal strength, and 4G/5G speeds depend on third-party local mobile operators, weather, physical obstruction, and regional capacity. Soliroush LLC does not guarantee uninterrupted network coverage in all locations.
- Device Compatibility & Carrier Lock: It is your responsibility to verify that your smartphone or tablet is eSIM compatible and carrier-unlocked prior to purchasing. Refunds will not be issued for locked or incompatible devices if the eSIM profile has already been downloaded.
7. Intellectual Property
The Services and all content, features, and functionality (including but not limited to software, text, displays, images, and the selection and arrangement thereof) are owned by Soliroush LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purposes, subject to these Terms. You may not copy, modify, distribute, sell, or sublicense any part of the Services.
You retain ownership of any content or data you submit to the Services. By submitting content, you grant Soliroush LLC a limited license to host, store, and process that content solely for the purpose of providing the Services to you.
8. Indemnification
You agree to defend, indemnify, and hold harmless Soliroush LLC, its partners, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:
- Your use of or access to the Services
- Your violation of any provision of these Terms
- Your violation of any third-party right, including intellectual property, privacy, or property rights
- Any claim that your use of the Services caused harm to a third party
9. Limitation of Liability
To the maximum extent permitted by applicable law, Soliroush LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Services.
Our total aggregate liability to you for any claims arising under or related to these Terms shall not exceed the greater of: (a) the total fees paid by you to Soliroush LLC in the twelve (12) months preceding the claim, or (b) one hundred US dollars (USD $100).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability; in such cases, the above limitations apply to the fullest extent permitted by law.
10. Disclaimer of Warranties
The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
11. Termination
We may suspend or terminate your access to the Services at any time, with or without cause and with or without notice, including for breach of these Terms. Upon termination:
- Your right to use the Services ceases immediately
- We may delete your account data in accordance with our data retention schedule (see Privacy Policy ยง4)
- Provisions that by their nature should survive termination (including intellectual property, indemnification, limitation of liability, and governing law) shall survive
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, USA, without regard to conflict of law principles, except where superseded by mandatory applicable law (including GDPR for EEA users and applicable consumer protection laws).
Pre-Chargeback Resolution Notice: Prior to initiating any credit card or payment gateway chargeback or dispute with your bank, you agree to contact Stixrs customer support via our Contact Form to attempt in good faith to resolve the issue. In the event of an unauthorized or fraudulent chargeback, Soliroush LLC reserves the right to immediately suspend your account and report fraudulent activity to fraud prevention databases.
Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in New Mexico, USA, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property or confidentiality violations.
13. Changes to Terms
We reserve the right to modify these Terms at any time. For material changes, we will provide at least 14 days' notice via email or in-app notification. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
